5-YEAR EXPRESS LIMITED WORKMANSHIP WARRANTY

LIMITED WARRANTY COVERAGE

TrueSon Exteriors warrants the installation of products to be free from defects in workmanship from the date of installation of the product for a period of five (5) years thereafter. TrueSon Exteriors agrees to repair or replace, without cost to Owner(s), any defective work and any damages caused by faulty workmanship and/or faulty installation done by TrueSon Exteriors or by persons under contract to TrueSon Exteriors for five (5) years following completion. This warranty shall supersede any implied builder warranty as prescribed by statutory or case law of the State of Missouri.

TrueSon Exteriors will not be responsible for defects in products covered by a manufacturer’s warranty, but will assume responsibility for correcting improper installation of such products. In no event does TrueSon Exteriors warrant the installed products.

Upon proper written notification of any alleged defect in workmanship as set forth below, TrueSon Exteriors shall have the right to inspect the areas at issue to determine the cause of the alleged defects. If the alleged defect are determined to be within the scope of this Limited Workmanship Warranty, TrueSon Exteriors shall make the necessary repair at TrueSon Exteriors’ sole expense. TrueSon Exteriors repair of the defect shall be the sole exclusive remedy available to the Owner(s).

TrueSon will not refund and/or pay any costs in connection with repairing any alleged defects if said repairs are performed by any entity and/or person other than TrueSon Exteriors.

CONDITIONS OF LIMITED WORKMANSHIP WARRANTY

TrueSon Exteriors liability to the Owner shall be subject to the following terms and conditions:

(A)    The Owner must provide proof that they are the Owner covered by this Limited Workmanship Warranty;

(B)    The Owner shall notify TrueSon Exteriors in writing of any alleged defects that need to be made or adjusted. The Owner shall provide notice within thirty (30) days of discovery of the alleged defects and prior to performing any permanent repair by the Owner or some other entity and/or person. The notice must describe the location and details of the alleged defects and such information as is necessary for TrueSon Exteriors to investigate the claim; and

(C)    Upon discovery of any alleged defects, the covered Owner must immediately, and at the Owner’s expense, provide for protection of all property that could be affected until the defects are remedied.

EXCLUSIONS

TrueSon Exteriors will not be responsible for damage to any times caused by fire, wind, or other natural causes, unless damage can be attributed to installation by TrueSon Exteriors. TrueSon Exteriors will not be responsible for damage to items that have been abused, neglected, misused, or otherwise purposely damaged by Owner (i.e., allowing drain tile to become clogged could cause a leak; keeping outside hoses hooked up to outside faucets during cold weather could cause water pipes to burst after thawing). TrueSon Exteriors will not be responsible for repairs or alternations made by anyone other than TrueSon Exteriors, settlement or structural movement, movement of materials to which installed products are attached, damages from incorrect design of the structure, acts of God, including, but not limited to, hurricanes, tornados, floods, earthquakes, severe weather or other natural phenomena, or lack of proper maintenance of an installed product by Owner. All living plants including sod require immediate maintenance from Owner and therefore are not warranted by TrueSon Exteriors. TrueSon Exteriors will not be responsible for splitting, cracking, or warping of treated lumber.

SETTLEMENT OF CLAIM(S)

Any repairs made by TrueSon Exteriors pursuant to this Warranty shall constitute a full settlement and release of all claims of any covered Owner hereunder for damages or other relief and shall be a complete bar to any litigation filed subsequently to the covered Owner’s acceptance of such agreement.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, STATUTORY OR OTHERWISE, EXPRESS OR IMPLIED, ALL REPRESENTATIONS MADE BY TRUESON EXTERIORS AND ALL OTHER OBLIGATIONS OR LIABILITIES WITH RESPECT TO THE HOUSE AND/OR STRUCTURE COVERED BY THIS WARRANTY.  IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS ARE EXPRESSLY EXCLUDED FROM THIS WARRANTY AND TRUESON EXTERIORS’ OBLIGATION SHALL NOT EXCEED ITS OBLIGATION SET FORTH IN THIS WARRANTY.

This Warranty is Non-Transferable.
